従来から各種分野で標準化がなされ製品やサービスの普及に寄与している。しかしながら，近年は技術標準に係る特許が標準活動を妨げている例も散見されるようになった。本稿では，主に米国において技術標準普及に際して特許権者が権利行使したことにより裁判等になった事例を紹介し，今後の技術標準普及と特許権の権利行使のあり方について考察する |

Standardization was made in various fields from the former, and it has contributed to the spread of a product or services. However, a standard and the example for which the patent concerning especially a technical standard has barred the spread of technical standards also came to appear here and there in recent years.
In this paper, when the patentee mainly did the exercise on the occasion of technical standard spread in the U.S., the example which became a trial etc. is introduced and the state of the technical standard spread of future and the exercise of patent right is considered |
