近時、ネットワークを巡って著作権問題が顕在化し、また、ファイル共有ソフトの作成者が著作権侵害の幇助で逮捕されるという事件が発生するにいたって、著作権侵害の問題は再考察せざるを得ない状況になっていると思われる。本稿では、いわゆるWinny事件に焦点を当て、現行著作権制度をインターネットに適用した場合の問題点を指摘し、今後の著作権制度とその規制のあり方を検討するものである． |

Recently, there has been many problems regarding the current system of copyright on the Internet . For instance, a developer of a file-sharing software was arrested on suspicion of assisting to violate the copyright law. The need to reconsider the current system of copyright is obvious.
In this paper, focusing on the so-called "Winny" case, we examine the problematic points when applying the present copyright system to the Internet. Addition to that, we examine the copyright system that will fit the future needs. |
