Some vulnerability fall into the “defect” for which developer is responsible legally and the other is nothing more than inappropriate function. It is because it is caused by “attack by third party” and “by change of circumstances after the license agreement”. If such inappropriate function has no importance with economical purpose of the agreement, vulnerability has nothing with legal effects. When the vulnerability fall into “defect” legally, liability set out Civil Law section 570 should be adopted. |
