| 抄録 | （和） | 従来，国家公務員法，地方公務員法，自衛隊法は，それぞれ，国家公務員，地方公務員，並びに，防衛省の職員及び自衛官に守秘義務を規定する一方，故意に守秘義務に違反する行為を処罰した。ところが，2013年12月に制定され，2014年12月に施行された特定秘密保護法は守秘義務違反を処罰するだけでなく，更に特定秘密を不正に取得する行為も処罰するものである。このような観点から特定秘密保護法は戦後で最初のスパイ防止法という側面がある。しかしながら，特定秘密保護法は研究者が研究したり，学会発表する行為までをも取り締まるものではなく，これらの行為に対して特定秘密保護法の刑罰規定が及ぶものではない。憲法に定める学問の自由の重要性を強調するとともに，学問の自由は刑法35条に規定する正当業務行為の解釈に反映されるべきである。 |
| （英） | Conventionally, the National Government Official Act, the Local Government Official Act, and the Self Defense Forces Act in Japan provide obligation to keep secret on the public officials in the national government, the local governments, and the Ministry of Defense as well as the Self Defense Forces, respectively, and an act of intentionally violating the secrecy obligation is punishable under the law. Act on the Protection of Specially Designated Secrets, which is abbreviated as the State Secrecy Act hereinafter, was enacted in December, 2013 and enforced in December 2014. The State Secrecy Act introduces new provisions to punish the illegal acquisition of secret information in addition to the intentional violation of the secrecy obligation. Therefore, one of the objective of the State Secrecy Act prevents espionage activity, and this is the first time in the history of the Japanese legal system after the WWII to incorporate the counter espionage measures. However, the State Secrecy Act would not impede the research activity nor the presentation and publication of the results of the research. Academic freedom in the Constitution of Japan is emphasized against the potential abuse of the State Secrecy Act. Specifically, an act committed in the pursuit of lawful business is unpunishable under Article 35 in the Penal code of Japan, and an interpretation thereof should incorporate the academic freedom of Article 23 of the Constitution of Japan. | |
