(in English) The replication of third-party software in the realm of information security research has the potential to encroach upon the copyright of the said software. In this context, the Circuit Court of Appeals in the United States has determined that the replication of an operating system for the purpose of security research qualifies as fair use and does not constitute a violation of copyright. This case has garnered significant attention from researchers in the field of cybersecurity, with the Electronic Frontier Foundation and Public Knowledge submitting an amicus curiae. This report aims to analyze the aforementioned judicial ruling.
