| 抄録 | （和） | 本稿はいわゆる「日本版セキュリティー・クリアランス（適性評価）制度」を調査するものである．この制度は，2024年5月に「重要経済安保情報の保護及び活用に関する法律」として成立した．これは安全保障に支障を与えるおそれがある情報を「重要経済安保情報」に指定し，その取扱業務を漏えいのおそれのない者に限定するものである．セキュリティー・クリアランスと呼ばれる所以は，後者の認定において労働者に対する適正評価を経る点にある．本制度は特定秘密保護法の対象範囲を文官や民間人に拡大し，また，経済安全保障推進法に盛り込まれなかった適正評価制度を組み入れるもので，一つの画期をなす．また，本制度により日本企業が欧米の政府調達に参加しやすくなるともされており，その意味で，サプライチェーン・セキュリティの側面も持つ．しかし，国民の知る権利との関係での対象となる経済安保情報の指定の最小化や適正評価の対象者のプライバシー権をどう確保するのかなど，運用の適正についての課題が指摘されている．本稿では、本制度に関する議論を踏まえ，その内容と課題を整理する． |
| （英） | This paper examines the so-called "Japanese version of the security clearance (suitability assessment) system". This system was enacted in May 2024 as the "Act on the Protection and Utilization of Critical Economic and Security Information". This law designates information that may affect security as "important economic and security information" and restricts the handling of such information to those who have no risk of leakage. The reason it is called "security clearance" is because the latter certification is based on a proper evaluation of employees. This system is a milestone because it expands the scope of the Protection of Specified Secrets Act to civilian officials and civilians, and includes a proper evaluation system that was not included in the Economic Security Promotion Act. It is also said that this system will make it easier for Japanese companies to participate in government procurement in Europe and the U.S. In this sense, the system also has a supply chain security aspect. However, there are issues to be addressed regarding the appropriateness of the operation of the system, such as how to minimize the designation of economic and security information subject to the system in relation to the public's right to know, and how to ensure the privacy rights of those subject to due diligence. This paper summarizes the contents and issues based on the discussions on this system. | |
