| 抄録 | （和） | サイバー攻撃によって生じた損害については，攻撃者に対する責任追及が現実的に困難であることから，被害企業及びその関係当事者間において損害を分担せざるを得ない状況が生じている．このような状況のもとでは，「サイバーセキュリティに関し，いかなる程度の対策を講じていれば法的責任を免れ得るのか」「サプライチェーンを通じて波及した損害について，どの範囲まで責任を負うべきか」「当事者双方に過失が認められる場合，責任割合はいかにして決定されるのか」といった問題が提起される．本稿は，これらの問題に対する一定の解答を提示することを目的として，損害賠償責任を構成する「債務不履行・過失」「損害・因果関係」「過失相殺」という3つのフェーズに着目し，それぞれにおける判断基準（責任分界点）の明確化を試みるものである． |
| （英） | With respect to damages caused by cyberattacks, it is often impracticable to pursue liability against the attackers. Consequently, such damages must be allocated among the affected companies and their related parties. Under these circumstances, several issues arise, including the following: to what extent cybersecurity measures must be implemented in order to avoid legal liability; to what extent liability should be borne for damages that propagate through supply chains; and how responsibility should be apportioned when both parties are found to be at fault. This paper aims to provide tentative answers to these issues by focusing on three phases that constitute liability for damages—namely, breach of contract and negligence, damages and causation, and comparative negligence—and by clarifying the criteria (i.e., the boundaries of liability) applicable at each phase. | |
