(in English) Software as technical information are in principle made public to be protected as copyrighted works of program or invention. On the other hand, source code of software is to be protected as a trade secret without being made public. In this regard, disclosure of source code of software is going to be required for the operating system of Microsoft Co., both by the European Commission from a perspective of the EU’s antitrust rules and by the People’s Republic of China based on “Mandatory certification scheme for IT (information technology) security products”. The problem of source code disclosure may be said to have emerged from a perspective of intellectual property management and security management of software function amid the diversity of legal protection for software. In the paper, we make it clear how intellectual property as technical information are protected and consider the correlated problems in relation to disclosure of technical information and restriction of intellectual property protection as well.
