Correlation Problems between Security Protection and Intellectual Property Protection of Information

(in English) The right of information covered by security protection is discussed in terms of privacy. On the other hand, when it is discussed in terms of intellectual property protection, the right of such information is seen from the aspect of proprietary nature. The recognition difference of information will depend upon either it is interpreted by freedom of information law and private information protection law, or by intellectual protection law. Private information and company information which are treated as nondisclosure information in freedom of information law has such correlation with intellectual protection law that former may interfere the latter which is based on the premise of information disclosure. The issues of this correlation between security protection and intellectual property protection of information will require consistency between private information right and company information right which should possess common nature originally. This report discusses rational structure of information right from the viewpoint of the correlation between freedom of information law and private information protection law and intellectual protection law with regard to nondisclosure information.
